Farm Evictions

Archer Attorneys guides owners and persons in charge through the legal process, from assessing occupation rights to recovering possession lawfully.

A lawful sequence

The farm eviction process,
made understandable.

When a former employee or another resident remains on farm or rural land, the correct eviction process depends on how they came to live there, whether residence was linked to employment and what other rights may exist. Establishing these facts early helps identify the correct legal route before notices are issued or court proceedings begin.

Identify every resident and establish the relevant facts

We identify each adult resident, dependant and source of occupation, then test which tenure law may apply. Locks, services, access, roofs and possessions must not be used as pressure while the lawful route is established.

Confirm authority and understand each occupier's rights

We verify ownership and the person in charge, then trace consent, employment, residence and any family, grazing, cultivation, burial, access or improvement rights. Each resident may have an independent legal position.

Terminate the right of residence fairly

Each occupier’s right of residence must be terminated lawfully and fairly. If that right depends solely on employment and the termination of employment is disputed, the dispute must first be determined under the Labour Relations Act before employment termination can be relied on to end the right of residence or pursue eviction.

Complete the required steps and prepare the court case

After lawful termination and the required preconditions, notices must be served and proved. In an ESTA eviction, the parties must attempt mediation or arbitration; reports and municipal or departmental information may also be required.

Obtain the order and recover possession lawfully

The court tests the statutory requirements, hardship, accommodation and safeguards. In an ESTA case, the occupier must be legally represented unless state-funded representation is expressly waived and the court finds that the interests of justice will not be harmed. Only the sheriff may carry out an authorised eviction.

Common questions

Questions owners often ask about farm evictions.

Can a farm resident be evicted as soon as employment ends?

No. Ending employment does not by itself end the right of residence or complete the eviction process. If the dismissal is disputed, the CCMA or Labour Court process must first be resolved before the employment termination can be relied on to end a residence right that depends solely on employment.

Does ESTA apply to everyone who lives on a farm?

No. The circumstances of each person must be checked. In some cases, the Labour Tenants Act, PIE or another legal right may apply instead of ESTA.

Can an owner change the locks, cut services or restrict access?

Do not assume self-help is lawful. Blocking access, disconnecting water or electricity, removing part of a dwelling or moving possessions without agreement or lawful authority can lead to urgent court proceedings and may interfere with separate statutory rights.

Is giving two months' notice enough?

No. Prescribed notice is only one part of the process. The right of residence must first have been lawfully and fairly terminated, the statutory preconditions must exist, every required recipient must be served and the court must have the information needed for its fairness enquiry.

What if a spouse, family member or long-term resident also occupies the property?

Each adult's status and possible independent right must be assessed. Age, disability, length of residence, family history and the circumstances in which each person came to live on the land can materially change the route and the relief a court may consider.

How long can a farm eviction take?

There is no reliable fixed duration. Employment disputes, representations, mediation, notice periods, reports, service, opposition, court procedure, accommodation evidence and any appeal or review can all affect timing.
